Legally, should attempt at "black magic" to someone be considered a threat of violence?

IMO, if the intent is genuine and the intended harm is grievous, then yes.

Just like a failed assassination attempt is a crime, a failed assassination (or bewitching or whatever) attempt using black magic should still be a crime. The fact that it couldn't have succeeded anyway is irrelevant if the aggressor genuinely thought it could.
